Fields of Elysium Estates LLC is not a licensed mortgage broker, lender, or real estate brokerage. We do not originate, fund, or service mortgage loans. Instead, we operate as capital raisers, private money and institutional money finders, and financing consultants. Our role is to connect qualified borrowers with private and institutional lenders who provide financing.

We do not engage in activities that require licensing as a mortgage broker or lender in the states where we operate. Our services comply with all applicable federal and state laws governing capital raising and consulting activities.

Private money loans facilitated through Fields of Elysium Estates LLC are offered by private and institutional lenders, not by Fields of Elysium Estates LLC itself. All lending decisions, loan terms, and underwriting are solely the responsibility our lending partners.

Important State-Specific Disclosures

For California

  1. Hazard insurance exceeding the replacement value of the real property is not required as a condition of your loan.

  2. THE HOUSING FINANCIAL DISCRIMINATION ACT OF 1977 — FAIR LENDING NOTICE
    It is illegal to discriminate in the provision or availability of financial assistance because of:

  • Trends, characteristics, or conditions in the neighborhood or geographic area surrounding a housing accommodation, unless such consideration is necessary to avoid an unsafe and unsound business practice; or

  • Race, color, religion, sex, marital status, national origin, or ancestry.

It is illegal to consider the racial, ethnic, religious, or national origin composition of a neighborhood or geographic area surrounding a housing accommodation, or changes in such composition, in appraising a housing accommodation or in determining whether or under what terms to provide financial assistance.

These provisions govern financial assistance for purchase, construction, rehabilitation, or refinancing of one- to four-unit family residences occupied by the owner, and for home improvement of any such residence.

For District of Columbia

Hazard insurance may be required by the private lender as a condition of credit. You have the right to obtain insurance through an agent or insurer of your choice, either through an existing policy or a new policy paid by you. The lender may reject insurance policies based on reasonable, uniformly applied standards relating to coverage extent, financial soundness, and service quality, but shall not discriminate against particular insurance types or reject policies with additional coverage beyond what is required.

For Kansas

Interest rates or charges are not recommended, approved, set, or established by the State of Kansas.

For New Jersey

Notice to the Borrower:
You may be required to purchase property insurance as a condition of receiving the loan. If required, you may secure insurance from a company or agent of your choice.

For Ohio

Ohio law prohibits discrimination and requires creditors to make credit equally available to all creditworthy customers. Credit reporting agencies must maintain separate credit histories upon request. The Ohio Civil Rights Commission enforces compliance.

For Oklahoma

Title Protection Notice pursuant to Oklahoma Statutes Title 46 Section 20(A) (purchase-money loans only):
The private lender will receive a title insurance policy protecting its interest in the secured property. This policy protects only the lender's interest and does not provide you with title insurance protection. You should seek independent advice about obtaining an owner’s title insurance policy. If desired, it must be obtained promptly to avoid closing delays.

For South Carolina

Loans may require waiver of foreclosure appraisal rights. In any real estate foreclosure proceeding, a defendant may apply within 30 days after sale for court-ordered appraisal. The approved appraisal replaces the sale bid and may reduce deficiency amounts. The borrower waives and relinquishes these appraisal rights, meaning the high bid at judicial foreclosure will apply to the debt regardless of appraised value.

For Texas

Consumers may file complaints against licensed mortgage loan originators with the Texas Department of Savings and Mortgage Lending, 2601 North Lamar, Suite 201, Austin, TX 78705. Complaint forms and instructions are available at www.sml.texas.gov. A toll-free consumer hotline is 1-877-276-5550.

The Department maintains a recovery fund for certain out-of-pocket damages caused by licensed originators. Applications must be filed and investigated before payment. More information is available at www.sml.texas.gov.
