  • Trends, characteristics, or conditions in the neighborhood or geographic area surrounding a housing accommodation — unless such consideration is required to avoid an unsafe or unsound business practice in a specific case; or

  • Race, color, religion, sex, gender, gender identity, gender expression, sexual orientation, marital status, national origin, ancestry, familial status, source of income, disability, veteran or military status, or genetic information.

It is also illegal to consider the racial, ethnic, religious, or national origin composition of a neighborhood or whether such composition is changing or expected to change when:

  • Appraising a housing accommodation

  • Determining whether or under what terms to provide financing

These protections apply to financial assistance offered for:

  • The purchase, construction, rehabilitation, or refinancing of one- to four-unit owner-occupied family residences

  • Home improvement for any one- to four-unit family residence
