Privacy Notice for California Residents

This Privacy Notice supplements the information contained in the Privacy Policy of Estates of Elysium LLC ("Estates of Elysium", "we", "us", or "our") and applies solely to visitors, users, and others who reside in the State of California ("consumers" or "you"). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (CCPA), as amended by the California Privacy Rights Act (CPRA), and other California privacy laws. Any terms defined in the CCPA/CPRA have the same meaning when used in this notice.

Information We Collect, Use, and Share

We collect information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device ("Personal Information"). This includes “Sensitive Personal Information” as defined by California law.

Personal Information does not include:

  • Publicly available information from government records

  • De-identified or aggregated consumer information

  • Information exempt from the CCPA/CPRA, such as that covered by certain federal privacy laws (e.g., FCRA, GLBA, HIPAA)

  • Identifiers: Name, mailing address, email address, phone number, IP address, driver's license number, or similar identifiers

  • Protected Class Information: Age, gender, marital status (if provided in forms)

  • Commercial Information: Property ownership details, investment interests, or transactional records

  • Internet/Network Activity: Interactions with our website, forms, or communications

  • Geolocation Data: General or precise location based on your device settings

  • Audio/Visual Information: Recordings of calls or videos (if applicable)

  • Inferences: Derived insights about preferences or behavior from the above data

Categories of Sensitive Personal Information We May Collect

  • Government-issued identifiers (e.g., SSN or driver’s license) when required for certain transactions

  • Financial data if voluntarily provided for deal participation

  • Racial or ethnic data only if voluntarily disclosed and required by law or for demographic reporting (not for discriminatory use)

We do not use or disclose sensitive personal information in ways that require the “right to limit” under the CPRA.

We collect Personal Information from:

  • You directly (via property submission forms, investor forms, or consultations)

  • Your interactions with our website or social media channels

  • Referral partners or third-party sources

  • Public records or real estate platforms

Business Purposes for Collecting Personal Information

We use your Personal Information to:

Only you, or someone legally authorized to act on your behalf, may make a verifiable request related to your Personal Information. We will verify your identity by matching your request with the data we hold or by requesting additional verification information if needed.

How We Verify Requests

  • If you have an account: We may verify using your existing login credentials

  • If you don’t have an account: We may require at least two to three identifying data points

We will only use information collected during verification to process your request and verify your identity.

Financial Incentives

Estates of Elysium does not currently offer financial incentive programs related to the collection, sale, or retention of Personal Information. If we begin offering such a program, you will be provided with clear terms and the option to opt in.

Non-Discrimination

We will not discriminate against you for exercising your privacy rights under California law. This means we will not:

  • Deny you services

  • Charge you different prices or rates

  • Provide a different level of service

  • Suggest you may receive different treatment
